Brown Surplus Recovery LLC is a surplus funds recovery service. We help former property owners identify and claim excess proceeds from tax sales, sheriff sales, and constable sales. We are not a law firm and do not provide legal advice. In states where attorney representation is required, we coordinate with licensed attorneys.
Submitting a claim review request through our website is free and creates no obligation on your part. We will research public records and contact you only if we find evidence of funds that may be available to you.
If you choose to proceed with our services, you will be asked to sign a written fee agreement before we begin any work. The fee agreement will specify:
No fee is owed unless we successfully recover funds on your behalf. Fee percentages comply with applicable state law, including any statutory caps.
We cannot guarantee that a claim will be approved or that funds will be disbursed. Counties may deny claims, set-offs may apply (e.g., remaining mortgage debt), or funds may have already been claimed. We will advise you of any complications as soon as we learn of them.
You agree to provide accurate information and cooperate with our reasonable requests for documentation (such as proof of identity and ownership). Providing false information voids any fee agreement and may constitute fraud.
Use of this website and our services does not create an attorney-client relationship. Any attorneys we engage on your behalf in attorney-required states will have their own engagement letters and professional obligations to you.
To the fullest extent permitted by law, Brown Surplus Recovery LLC's liability is limited to the fees actually paid by you under a fee agreement. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by applicable state and federal law. Any disputes will be resolved in the jurisdiction where the property giving rise to the claim is located.
We may update these Terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of the site after changes constitutes acceptance.
